Public Liability Insurance in Victoria: Cover and Cost Guide

Public Liability Insurance in Victoria: what local businesses should know about cover, cost factors and choosing a policy in Victoria, Australia.

Public liability insurance Victoria searches usually come down to three questions: is it compulsory, what does Victorian insurance duty do to the price, and which state law sets negligence. This guide answers each from official Victorian sources where we could read them, and says clearly where we could not. For definitions and the national position, our main guide comes first.

Quick answer

We found no Victorian law requiring every business to hold public liability cover. Victoria is phasing out duty on certain business insurance premiums, and we could not confirm the current rate. Check the State Revenue Office.

Is Public Liability Insurance Compulsory in Victoria?

We found no Victorian rule that requires every business to hold it, and business.gov.au says only that some states and territories need it for certain occupations. Business Victoria describes public liability as useful for any business that deals face to face with customers, and separately lists compulsory items: WorkCover for employers and third party injury insurance for business vehicles. That page is undated, so re-check it.

The requirement most likely comes from a contract, a lease or a licensing body, so ask each for its current wording. Our national guide explains where those requirements come from.

Insurance Duty on Business Insurance in Victoria

Victoria is reducing duty on business insurance in steps. The table shows what we could confirm, and it separates official pages from an industry view.

Date What the source says
1 July 2024 The State Revenue Office says duty on certain business insurance premiums is being phased out over 10 years from this date
1 July 2024 The National Insurance Brokers Association, an industry body, said the rate fell from 10 per cent to 9 per cent, and that it would keep falling by 1 percentage point a year
16 October 2024 The SRO published ruling DA-068, which covers what business insurance is and when the reduced rate applies
1 July 2025 The SRO says the rate reduces from 9 per cent to 8 per cent
Current year We could not read the SRO's current rates page

Three cautions apply. First, the SRO news pages do not name public liability, so we cannot confirm how the rate applies to your policy. The NIBA article lists public and product liability among the classes in scope, but it is an industry view. Second, the SRO page on abolition of duty on business insurance showed only its title when we read it, with an update date of 22 October 2026, so we could not read its text. Third, we could not read the current-year rate, so we do not state one. Check the SRO's rates page for your policy's start date.

Negligence and Victorian Law

A public liability claim usually turns on negligence. In Victoria, the Wrongs Act 1958 deals with it: an AustLII listing of the Act shows Part X, Negligence, with a division on duty of care. We cite it as a listing only, and we do not explain the Act. Our what-is-it guide explains the negligence idea in plain English, and a lawyer can advise on a specific claim.

Practical Checks for Melbourne and Regional Victoria

Picture a Melbourne sole trader who is asked by a new client for proof of cover. The client wants a certificate naming the business, a limit and the policy dates. A Victorian business should ask the same questions as anywhere else:

  1. Does a contract, lease or licence set a minimum limit?
  2. Does the policy name the exact business entity?
  3. Does the quote show duty and how it was calculated?
  4. How fast can the insurer issue a certificate of currency?

Business Victoria says brokers must act as your representative and that AFCA can help with insurer disputes, although AFCA's role for public liability is limited, as our national guide explains. Our sole trader guide and quotes guide cover the rest.

Where to Go Next on Cairn Cover

The one thing to remember: for public liability insurance Victoria readers should check duty on the date the policy starts, because the rate is changing. Cairn Cover explains how cover works, links each source on the words it supports and does not sell insurance or give personal advice. Read the national guide, the cost guide and our Queensland guide for a state comparison.
