Public liability insurance Canberra searches usually come down to what is different in the Australian Capital Territory (ACT). This guide covers what we verified: the ACT's position on insurance duty, its workers compensation rule and its negligence law. It also says where we found nothing. For definitions and the national position, read our main guide first.
Quick answer
We found no ACT law requiring every business to hold public liability cover. The ACT says it abolished insurance duty in 2016. ACT employers must hold a workers compensation policy, which is a separate cover.

Is Public Liability Insurance Compulsory in the ACT?
We found no ACT rule that requires every business to hold it. The ACT Government's protect your business page, last updated on 30 June 2026, lists public liability among the most common insurances and professional indemnity among others you may need, without calling either compulsory. business.gov.au says some states and territories need public liability for certain occupations, but it does not list ACT ones, and we did not verify any ACT licence that sets a minimum.
The requirement is therefore most likely to come from a client, a lease or a licensing body. Ask each for its current wording before you buy. Our national guide explains where those requirements arise.
Workers Compensation Is a Separate Duty
The same ACT page says an employer must hold a current ACT workers compensation policy with an approved insurer, and explains that injured workers can claim on it for lost income, medical costs and rehabilitation. This is the rule that does apply to staff. Public liability cannot stand in for it, because public liability responds to people outside your business. Our what-is-it guide explains the split.
Insurance Duty in the ACT
Most Australian states charge a tax on general insurance premiums. The ACT is different. The ACT Revenue Office tax reform page says insurance duty was abolished on 1 July 2016 as part of the ACT's tax reform, that 10 per cent applied to general insurance premiums before then, and that the ACT is the only state or territory to have completely abolished it. The page is undated, so we treat the statement as the Revenue Office's own, and the other jurisdictions' positions as ones to check on their own pages.
The so what: a quote for an ACT business should not carry state insurance duty, so ask your insurer to confirm that none has been added. Duty elsewhere is covered in our cost guide, and each state guide, such as Western Australia, sets out its own rule. Be careful with online articles that apply another state's rate to the ACT.
Negligence Claims Under ACT Law
A public liability claim usually turns on negligence. In the ACT the main statute is the Civil Law (Wrongs) Act 2002. Section 43, in the version current as of 16 May 2026, says a person is not negligent in failing to take precautions against a risk of harm unless the risk was foreseeable, the risk was not insignificant and a reasonable person in that position would have taken precautions. A court weighs how likely and serious the harm was, the burden of precautions and the usefulness of the activity.
The practical point is that an injury alone does not settle who is responsible. Our what-is-it guide explains the test in plain English. We do not give legal advice, so speak to a lawyer about a specific claim.
Practical Checks for Canberra Businesses
Picture a Canberra sole trader whose new client asks for proof of cover before work starts. The trader needs a certificate that names the right entity, shows current dates and meets any minimum in the contract. These checks apply anywhere in the ACT:
- Does a client, lease or licence set a minimum limit?
- Is the policy in the exact name that signs the contract?
- Does the quote show whether any duty has been added?
- How fast can the insurer issue a certificate of currency?
Our sole trader guide and quotes guide cover the rest.
